Charge Reduced: Felony DUI Case Resolved as Misdemeanor
A client facing serious felony charges avoided prison time and a felony record thanks to a strong defense strategy.
The client, a Rancho Cucamonga client in his thirties, was arrested and charged with felony DUI with injury under Vehicle Code 23153(a) and (b), a charge that carries the possibility of prison time and a permanent felony record.
On review of the evidence, it was clear that despite being charged as a felony, the conduct was more consistent with a misdemeanor. After bringing this to the attention of the District Attorney's office, along with a significant mitigation plan we put in place for the client, the District Attorney's office agreed to reduce the felony DUI causing injury charge to a misdemeanor.
As a result, the felony charge was reduced, and the client pled to a misdemeanor instead. He avoided a prison sentence entirely and avoided a felony conviction on his record. This outcome allowed him to continue his career successfully, without the lasting consequences a felony DUI conviction could have caused.
